婆婆控公媳通姦　成功討回11房產

【綜合報導】台中市71歲老翁被控在2008年間與35歲媳婦通姦生子，被判有罪確定，5年前兒子去世後，婆婆主張中國籍媳婦繼承的11筆價值共數千萬元房產，因通姦生子應喪失繼承權；台中地院認定，依《兩岸人民關係條例》，媳婦三年內未向法院提出繼承，視同拋棄繼承權，昨判媳婦繼承權不存在。

判決指出，去年媳婦因通姦生子而被撤銷戶籍，依法繼承遺產限額二百萬元，且須在三年內向法院提出，但她卻遲遲沒依規定向法院聲明繼承，依法就應視為拋棄繼承權，昨判決她當年繼承十一筆市價數千萬元房產，應塗銷登記。全案仍可上訴。
