工人醉睡公車地板 殺傷勸阻司機賠5萬

【孫友廉／新北報導】林姓工人（58歲）去年5月20日晚間，酒後自台北市中華路搭乘台北客運702公車，但上車沒多久，林男就脫鞋睡臥走道，吳姓司機（38歲）前來勸阻，林男卻趁吳男開車時，持美工刀攻擊吳男頸部。吳男奮力抵抗搶下美工刀，卻右肩脫臼，左手腕、右頸受傷。
刑事案開庭時，林男稱願以20萬元和解，但吳男認為因右肩被林男弄傷，以致無力操作排檔，被調離原路線，改駕駛低地板自排公車，1年多來薪資已少19萬餘元，加上精神慰撫金30餘萬元，要求吳男共賠50萬元，因兩方無法和解，高等法院今年5月依傷害罪判林男1年6月徒刑。
新北地院板橋簡易庭日前宣判吳男求償案，認為吳男傷勢尚非嚴重，仍可復原，尚未構成工作能力減損，又無法證明薪水減少跟此受傷有關，僅判決林男須賠償精神慰撫金5萬元；全案尚可上訴。
