擅貼照賣觸控筆 禮品公司遭訴

（中央社記者劉世怡台北14日電）一家電子禮品公司負責人被控下載他人攝影著作，張貼自家網站並賣手寫觸控筆。台北地方法院檢察署依違反著作權法起訴負責人。

檢方表示，禮品公司許姓負責人被控未經知名觸控筆公司同意，擅自從網路上下載與觸控筆有關的攝影著作，從民國100年10月間起重製攝影著作後，張貼在自家公司網站，用以販售自家的萬用式鋁質手寫觸控筆產品。

檢方說，後來觸控筆公司人員發現後，委託律師向檢警報案。

檢警偵辦期間，許姓負責人否認犯行並表示，公司販售的觸控筆自中國大陸進口，攝影作品是美工人員從中國大陸網站擷取。

檢方指出，遭侵權的公司人員指訴歷歷，且有攝影著作可比對，認定許男犯行明確，依違反著作權法起訴，公司則科以罰金。1020714
