馬總統除夕到署立雙和醫院慰勞留守的醫護人員時，以加拿大「道歉法」為例表示，將修法讓醫師責任明確化，降低執業恐慌；過去14年最高法院判定醫護人員有刑責僅7案，都拘役或易科罰金、不必坐牢，但案件審3年或拖14年，實在沒意義，不如調整醫病關係。他已邀醫病代表研商獲共識，將修法讓醫師責任明確化、避免執業恐慌。
