報導自殺女大生染肺結核　網路媒體判罰9萬

今日傳媒公司(nownews)2011年10月20日，在「今日新聞網」上，貼出「快訊／氣情緒不穩北捷跳軌／日籍女大生不治身亡」報導，內文提及當事人有法定傳染病肺結核，遭台北市政府衛生局依違反《傳染病防治法》，不得洩漏染病者資訊的規定，裁罰9萬元。
 
今日傳媒公司不服，認為報導有關公共利益，且《傳染病防治法》是規範醫療人員，而且當事人已死亡，無保護隱私必要，提行政訴訟要求免罰。
 
台北地院認為，《傳染病防治法》除規範醫療人員外，也規定其他因業務知悉傳染病資料者，均不得洩漏相關資料，今日傳媒也應受規範，當事人雖死亡，但其隱私仍應受保護，判今日傳媒敗訴。全案仍可上訴。

今日傳媒認為事涉公益，提起行政訴訟，一審敗訴。翻攝nownews首頁
