劉政鴻涉貪案 發交苗檢偵辦

（中央社記者劉世怡台北22日電）最高檢今天說，苗栗縣長劉政鴻被控貪污一案，審查完畢，認定非屬特偵組管轄的案件，今天簽結並發交苗栗地檢署依法辦理。

為抗議苗栗大埔案，台灣農村陣線19日到最高檢察署遞狀告發劉政鴻並指劉涉嫌向台電通霄電廠勒索回饋金新台幣10億元；劉政鴻又透過土地徵收獲取暴利，強行徵收大埔土地，卻又原地保留自家房屋淨賺高價；且他的財產不合理增加，劉政鴻涉嫌違反貪污治罪條例、圖利、財產來源不明等罪，要求特偵組介入偵辦。

最高檢今天指出，依法院組織法第63條之1第1項第1款規定，特偵組職司涉及總統、副總統、五院院長、部會首長或上將階級軍職人員的貪瀆案件，本件被告為縣長及他所涉財產來源不明罪等，非屬特偵組管轄案件，應發交由有管轄權的苗栗地檢署依法偵辦。

特偵組表示，經向台電公司調取資料顯示，苗栗縣政府要求於工程開工前，分二次將10億元全部撥付縣政府，此屬雙方在回饋金給付的金額、時程及撥付方式上意見不一致的問題，且雙方在回饋金的金額差異為1.95億元，就1.95億元的金額而言，非屬特殊重大。

最高檢指出，基於「檢察一體原則」，在必要時，將由台灣高等法院台中分院檢察署檢察長督導苗栗地檢署全力偵辦。1020822
