何江忠3人羈押庭 周五召開

(中央社記者邱俊欽桃園22日電）台灣高等法院撤銷洪仲丘案中被告何江忠等3人原獲交保裁定，發交桃園地方法院更裁，桃園地院明天上午重開羈押庭。

高院日前撤銷洪仲丘案中被告原獲軍事法院交保的相關裁定，發交桃園地方法院更裁。

桃園地方法院合議庭在收到高院的卷證後，經合議庭開會決定，基於「讓程序延續」，法官看完相關卷證，並傳喚當事人出庭後，定於明天召開羈押庭審理。

羈押庭明天將在桃園地院刑事第5法庭召開，將由審判長鄭吉雄、受命法官丁俞尹、陪席法官許菁樺組成的合議庭承審。

陸軍下士洪仲丘疑遭不當處分死亡案，涉案當時的陸軍前542旅副旅長何江忠、連長徐信正、上士范佐憲等人於軍事檢察官起訴後，均獲軍事法院交保。

高院指出，以全案共犯士官長陳以人與何江忠等3人的供述看來，何江忠等3人似已有串證事實，且軍人有上下服從命令的特質，若依被告3人的供述，旅長沈威志及副旅長何江忠均有召集部屬集合，教導面對軍事檢察官要如何回答的技巧，做出發交更裁決定。1020822
